1. Acceptance of Terms

These Terms and Conditions (“Terms”) govern your access to and use of the Unplugged Performance website (unpluggedperformance.com), products, and services. 

By accessing our website, placing an order, or purchasing any product, you agree to be bound by these Terms, our Warranty Policy, and our Privacy Policy. If you do not agree to these Terms, do not use our website or purchase our products.

2. Eligibility

You must be at least 18 years old and legally capable of entering into binding contracts to use our website and purchase products. By placing an order, you represent and warrant that you meet these requirements.

3. Products & Orders

3.1 Product Descriptions

We make every effort to ensure that product descriptions, images, and specifications on our website are accurate. However, we do not warrant that descriptions are error-free, complete, or current. Colors, dimensions, and fitment may vary slightly from images shown. If a product you receive is materially different from its description, your sole remedy is to return it under our Return Policy.

3.2 Pricing

All prices are listed in U.S. Dollars and are subject to change without notice. Prices do not include shipping, handling, duties, or applicable taxes unless otherwise stated. We reserve the right to correct pricing errors and cancel any orders placed at an incorrect price, even after order confirmation.

3.3 Order Acceptance

Your placement of an order constitutes an offer to purchase. We reserve the right to accept or reject any order at our sole discretion. An order is not binding until we send an order confirmation email. We may cancel orders due to pricing errors, product unavailability, suspected fraud, or other reasons at our discretion.

3.4 Made-to-Order Products

Products designated as made-to-order, custom, or build-to-order must be paid in full before production begins. These products are non-refundable and non-cancellable once production has commenced. Estimated production timelines are provided in good faith but are not guaranteed. Delays in production do not entitle the customer to cancellation or refund of a made-to-order product.

4. Payment

We accept major credit cards, debit cards, and other payment methods as indicated at checkout. All payments are processed through secure third-party payment processors (e.g., Shopify Payments, PayPal). By providing payment information, you represent that you are authorized to use the payment method. We do not store full credit card numbers on our servers.

5. Shipping & Delivery

5.1 Shipping Timelines

Shipping timelines and stock availability are estimates only and are not guaranteed. We do not promise any particular delivery timeline for any Risk of loss and title for products pass to you upon delivery to the carrier.

5.2 Shipping Damage

You must inspect all packages upon delivery. If you observe damage to the packaging or product:

• Note the damage on the delivery receipt/proof of delivery at the time of delivery
• Photograph all damage to packaging and product before discarding any materials, returning or repackaging the product, or installing the product
• Report damage to support@unpluggedperformance.com within 72 hours of delivery

FAILURE TO DOCUMENT DAMAGE ON THE SHIPPING RECEIPT AT THE TIME OF DELIVERY MAY VOID YOUR ABILITY TO FILE A FREIGHT DAMAGE CLAIM. Unplugged Performance is not responsible for shipping damage that is not properly documented and reported within the required timeframe.

5.3 International Shipping

International orders may be subject to import duties, taxes, and customs fees imposed by the destination country. These charges are the customer’s responsibility and are not included in the product price or shipping cost. We are not responsible for delays caused by customs processing.

6. Returns & Refunds

6.1 Standard Returns (New, Uninstalled Items)

• Return window: 31 days from date of delivery (worldwide)
• Items must be new, uninstalled, and in original packaging
• Full refund of product price minus original and return shipping costs
• Customer is responsible for return shipping costs
• Returns received after 31 days but within one (1) year of purchase are subject to a 30% restocking fee if approved by management.

6.2 Used/Installed Item Returns

• Return window: 31 days from date of delivery
• Subject to a 30% restocking fee, unless explicitly covered by our 31-day satisfaction guarantee policy as stated on the product listing
• Items must be in resalable condition
• Customer is responsible for return shipping costs and if Unplugged Performance provides a return label or ships the return at our expense, the shipping and handling costs incurred will be deducted from any refunds

6.3 Non-Returnable Items

The following items are NOT eligible for return or refund:

• Made-to-order, custom, or build-to-order products
• Final Clearance (SH2) or “as-is” items
• Installed items showing signs of use, wear, or damage, other than those covered with explicit 31-day satisfaction guarantee
• Items without original packaging
• Consumable / Wear Items (SH1) that have been used (brake pads, fluids, etc.)

6.4 Final Clearance Items (SH2)

Products marked as Final Clearance (SH2), final sale, or “as-is” are sold without warranty of any kind. ALL WARRANTIES, EXPRESS OR IMPLIED, ARE DISCLAIMED for Final Clearance items. These items are not eligible for returns, exchanges, or refunds except for documented shipping damage reported within 72 hours.

6.5 Discontinued Items

Unplugged Performance will generally not keep additional stock of discontinued items for potential warranty replacement or out of warranty service. In such cases as discontinued items need to be replaced under warranty, the warranty may be provided as an in-kind discount on another item.  Should a discontinued item need out-of-warranty service or replacement components, Unplugged Performance has no responsibility to make service or components available for purchase.

6.6 Refund Processing

Approved refunds will be issued to the original payment method within 10 business days of receiving and inspecting the returned product. Shipping charges are non-refundable except where the return is due to our error.

7. Warranty

Product warranties are governed by the Unplugged Performance Warranty Classification System, available at unpluggedperformance.com/warranty. Each product is assigned to one of ten warranty categories (A through J) or a special handling designation (SH1: Consumable / Wear Items, SH2: Final Clearance, SH3: Third-Party Products) that defines specific coverage terms, duration, and exclusions. The Warranty Classification System is incorporated by reference into these Terms. If you have questions about which warranty category applies to a product, please contact us prior to purchase. All warranties apply to the original purchaser only.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, UNPLUGGED PERFORMANCE AND BULLETPROOF AUTOMOTIVE, INC., INCLUDING THEIR OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND AFFILIATES, SHALL NOT BE LIABLE FOR:

• Any indirect, incidental, special, consequential, or punitive damages
• Any loss of profits, revenue, data, or business opportunity
• Any personal injury or property damage arising from product use or installation
• Any vehicle damage, including damage to OEM components, paint, electrical systems, or structural integrity
• Any damages exceeding the original purchase price of the specific product at issue
• Any labor costs related to installation, uninstallation, or failure of a product
• Any costs incurred as a result of the unavailability of your vehicle during installation, troubleshooting, or anything else related to our products
• Any costs incurred for a rental vehicle, ride share or alternative transportation
• Any costs related to warranty decisions by Tesla or any other third party where our products are referenced as an excuse for non-coverage or reduced coverage

This limitation applies regardless of the legal theory (contract, tort, strict liability, warranty, or otherwise) and whether or not we have been advised of the possibility of such damages.

9. Indemnification

You agree to indemnify, defend, and hold harmless Unplugged Performance, Bulletproof Automotive, Inc., and their officers, directors, employees, agents, licensors, and suppliers from and against all claims, losses, liabilities, expenses, damages, and costs (including reasonable attorneys’ fees) arising from: your use of our products, your violation of these Terms, your violation of any third-party rights, or any claim that your use of our products caused damage to a third party.

10. Intellectual Property

All content on unpluggedperformance.com, including but not limited to logos, trademarks, trade dress, product designs, images, text, graphics, and software, is the property of Bulletproof Automotive, Inc. or its licensors and is protected by U.S. and international intellectual property laws.

You may not reproduce, distribute, modify, create derivative works of, publicly display, or otherwise use any content from our website without prior written consent. Unauthorized use of our trademarks or copyrighted materials may violate federal and state trademark, copyright, and other laws.

“Unplugged Performance,” the Unplugged Performance logos, and all related product names are trademarks or service marks of Unplugged Performance, Inc. Use of these marks without authorization is strictly prohibited.

11. User Accounts

If you create an account on our website, you are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. You agree to notify us immediately of any unauthorized use. We reserve the right to suspend or terminate accounts at our discretion.

12. Prohibited Uses

You agree not to:

• Use our website for any unlawful purpose
• Attempt to gain unauthorized access to our systems or other users’ accounts
• Use automated tools (bots, scrapers) to access our website without authorization
• Interfere with or disrupt the website or servers
• Resell our products commercially without a dealer agreement
• Use our trademarks, logos, or content without authorization
• Crawl, copy or replicate any portions of our website
• Take product information from our website

13. Third-Party Links

Our website may contain links to third-party websites or services. We are not responsible for the content, privacy practices, or availability of third-party sites. Inclusion of a link does not imply endorsement.

14. Force Majeure

We shall not be liable for any delay or failure to perform our obligations due to causes beyond our reasonable control, including but not limited to: natural disasters, war, terrorism, epidemics, pandemics, government actions, supply chain disruptions, carrier delays, labor disputes, or infrastructure failures.

15. Governing Law & Dispute Resolution

These Terms shall be governed by the laws of the State of California without regard to conflict of law provisions. Any dispute arising from these Terms shall be resolved through the dispute resolution procedure set forth in our Warranty Policy (good faith negotiation, then mediation, then binding arbitration through JAMS in Los Angeles County, California).

YOU AGREE TO WAIVE ANY RIGHT TO A JURY TRIAL AND TO PARTICIPATE IN CLASS ACTION LAWSUITS OR CLASS ARBITRATIONS.

16. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable.

17. Entire Agreement

These Terms, together with our Warranty Policy and Privacy Policy, constitute the entire agreement between you and Unplugged Performance regarding your use of our website and purchase of our products. These Terms supersede all prior agreements, communications, and understandings.

18. Free Gift with Purchase Terms and Conditions (2026 Limited Edition Black Snapback)

Offer Overview

For a limited time, qualifying orders placed on unpluggedperformance.com with a merchandise subtotal of $999 USD or more are eligible to receive one free Unplugged Performance 2026 Limited Edition Black Snapback Hat, Gold Edition while supplies last.

Offer Period

Offer is valid from [Insert Start Date] through [5/19] (11:59pm Pacific Time), or while promotional inventory lasts, whichever occurs first.

Eligibility and Qualification

To qualify, the order must meet all of the following conditions:

1. The cart merchandise subtotal must be $999 USD or more at checkout.
2. Subtotal is calculated before shipping, taxes, duties, installation services, warranties, gift cards, and any additional fees.
3. Offer is valid for online orders only at unpluggedperformance.com.
4. Limit one free gift per customer and per order, regardless of the number of qualifying items purchased.
5. Offer applies to both guest and logged in customers.

Redemption

When the cart meets the minimum qualifying subtotal and no exclusions apply, the free hat will be automatically added to the cart at a $0 line price. The hat is a single simple product with no size or variant selection required. The customer completes checkout as usual and the hat ships with the order.

Exclusions and Promotion Stacking

This offer cannot be combined with certain other active promotions. Specifically:

1. Orders that contain wheels and also use an active free shipping coupon code from an Unplugged Performance email or marketing campaign are not eligible for the free hat. Customers may redeem the free shipping offer or the free hat offer on a qualifying wheel order, but not both simultaneously.
2. If multiple promotions or discount offers are presented, only the best offer may be applied at our discretion.
3. The free gift itself is not eligible for additional discounts and will remain priced at $0.

While Supplies Last

This promotion is available only while supplies last. Promotional inventory is limited and the hat is produced as a true 2026 limited edition with no planned restock. Once inventory is depleted, the offer ends automatically even if the campaign end date has not been reached. No rain checks will be issued.

Shipping and Handling

1. Shipping charges may apply to the free gift item.
2. Orders shipping outside the United States may not be eligible. If fulfilled, additional taxes, customs fees, and duties may apply and are the customer’s responsibility.
3. The free gift ships with the qualifying order unless fulfilled separately due to fulfillment logistics or inventory location.

Returns, Cancellations, and Exchanges

If an order is returned, exchanged, partially refunded, or cancelled and the updated merchandise subtotal falls below $999 USD, the order is no longer eligible for the free gift. The customer must return the hat with the qualifying items or the value of the hat at standard retail may be deducted from the refund.

No Substitutions and No Cash Value

1. No substitutions, exchanges, or cash alternatives are available.
2. The free gift has no cash value and is not transferable.

Technical and Fraud Protection

1. Unplugged Performance reserves the right to refuse, cancel, or adjust orders that appear to be fraudulent, abusive, or intended to manipulate the promotion, including multiple accounts or repeated orders to obtain additional free gifts.
2. In the event of site errors, system issues, or incorrect pricing, Unplugged Performance reserves the right to correct the issue and update or remove the promotional gift as needed.

Modification or Termination

Unplugged Performance may modify, suspend, or discontinue the offer at any time without notice, including changes to eligibility, dates, inventory availability, or fulfillment method.

19. MEMORIAL DAY WEEKEND BUNDLE SALE — PROMOTIONAL TERMS & CONDITIONS

These promotional terms apply specifically to the Memorial Day Weekend Bundle Sale (“the Event”) running May 20–25, 2026, and supplement Unplugged Performance’s standard Terms & Conditions available at unpluggedperformance.com/terms-and-conditions. In the event of a conflict, the standard Terms & Conditions govern except as explicitly modified below.

1. Promotion Period: The Memorial Day Weekend Bundle Sale begins May 20, 2026 for email list subscribers (early access) and opens to the general public on May 21, 2026 at 9:00 AM Pacific Time. The promotion ends at 11:59 PM Pacific Time on May 25, 2026, or while supplies last, whichever comes first. Orders must be placed and confirmed within this window to receive promotional pricing. Orders placed outside the promotion window will not be eligible for event pricing retroactively.

2. Eligibility: The promotion is available to customers who are at least 18 years old and legally capable of entering into binding contracts, consistent with Section 2 of Unplugged Performance’s standard Terms & Conditions. Early access (May 20) is limited to customers who are active subscribers to the Unplugged Performance email list at the time of launch. Unplugged Performance reserves the right to verify eligibility and cancel orders that do not meet the stated criteria.

3. Bundle Discount Tiers: Three discount tiers apply to eligible products during the promotion period:

• Tier 01: 30% off retail pricing on designated rare or limited-run wheel set configurations.
• Tier 02: 20% off retail pricing on select UP Upgrades
• Tier 03: 3% – 10% off retail pricing on a broader selection of in-stock configurations.

Tier assignments are fixed at the time of sale launch and are applied automatically at checkout for qualifying products. Tier classification is at Unplugged Performance’s sole discretion and may not be combined with any other promotional codes, loyalty points redemption, or prior-sale adjustments.

4. Inventory & Availability: All Memorial Day bundle pricing is subject to available inventory at the time of purchase. Displayed inventory counts are estimates and may not reflect real-time stock. Unplugged Performance reserves the right to limit quantities per customer and to end the promotion early if inventory is exhausted. Completing checkout does not guarantee fulfillment if inventory becomes unavailable between order placement and confirmation.

5. Bundle Structure & Configuration: Bundles are sold as complete four-wheel sets and may not be split into individual wheels. Optional tire package upgrades (Michelin Pilot Sport 4S, Michelin Pilot Sport 5S, or Pirelli P Zero) are available as add-ons and are not required to participate in the promotion.

6. Michelin National Discount Program / $80 Visa Reward: Customers who add a qualifying Michelin tire package (Michelin Pilot Sport 4S or Michelin Pilot Sport 5S) to their order may be eligible for the Michelin $80 Visa Reward via Michelin’s National Discount Program. This reward program is administered solely by Michelin and is subject to Michelin’s own terms, eligibility requirements, submission deadlines, and redemption process. Unplugged Performance makes no representations or warranties regarding the availability, processing, or fulfillment of any Michelin reward. Customers are responsible for submitting the redemption form independently. The Michelin $80 reward does not apply to Pirelli tire add-ons or other non-Michelin and non-qualifying Michelin tire models.

7. Pricing & Order Confirmation All promotional prices are listed in U.S. Dollars. Prices do not include shipping, handling, applicable taxes, or duties unless otherwise stated. Unplugged Performance reserves the right to correct pricing errors at any time, including after an order has been placed, consistent with Section 3.2 of the standard Terms & Conditions. A promotional order is not binding until Unplugged Performance sends an order confirmation email. We reserve the right to cancel orders resulting from pricing errors, inventory discrepancies, suspected fraud, or any other reason at our discretion.

8. Cancellations, Returns & Refunds Standard return and cancellation policies under Section 6 of Unplugged Performance’s Terms & Conditions apply to all Memorial Day Weekend Bundle Sale purchases, with the following clarifications:

• Items purchased at promotional pricing are eligible for return within 31 days of delivery if new, uninstalled, and in original packaging. Refunds will be issued at the promotional purchase price, not at full retail.
• Promotional pricing may not be applied retroactively to orders placed prior to the sale window. Price adjustments for prior purchases will not be honored.

9. Shipping Estimated shipping timelines provided at checkout are estimates only and are not guaranteed, consistent with Section 5.1 of the standard Terms & Conditions. Memorial Day Weekend Bundle Sale orders may experience increased processing times due to order volume. Customers are responsible for inspecting all packages upon delivery and reporting any shipping damage within 72 hours per Section 5.2. Risk of loss transfers to the customer upon delivery to the carrier.

10. Exclusions The Memorial Day Weekend Bundle Sale discount does not apply to: previously purchased orders, gift cards, labor or installation services, non-participating products, or items already marked as Final Clearance (SH2) or Consumable/Wear Items (SH1). Promotional pricing cannot be combined with any other active discount codes, corporate pricing, dealer pricing, or UP Rewards points redemptions unless explicitly stated in the promotion materials.

11. Limitation of Liability Unplugged Performance’s standard limitation of liability under Section 8 of the Terms & Conditions applies in full to all Memorial Day Weekend Bundle Sale transactions. Unplugged Performance is not liable for any inventory inaccuracies, system errors, or pricing discrepancies displayed during the promotion period. Participation in this promotion does not alter, expand, or modify any product warranty. Warranty coverage remains governed by the Unplugged Performance Warranty Classification System at unpluggedperformance.com/warranty.

12. Modifications & Cancellation of Promotion Unplugged Performance reserves the right to modify, suspend, or cancel the Memorial Day Weekend Bundle Sale at any time, for any reason, without prior notice. In the event of a system error, unauthorized access, or fraud affecting the integrity of the promotion, Unplugged Performance may void affected transactions. Unplugged Performance’s decision on all promotional matters is final.

13. Governing Law These promotional terms are governed by the laws of the State of California. Any disputes arising from this promotion shall be resolved per the dispute resolution procedure outlined in Section 15 of Unplugged Performance’s standard Terms & Conditions.
